Enhanced Athlete Demands Proof

Enhanced Athlete is based in a Cheyenne, Wyoming. It sells products  for bodybuilding purposes. The company successfully had an injunction overturned by the United States of the Eastern District of California. Nutrition Distribution based the injunction on false advertising. However, the company has filed at least 70 lawsuits against nutritional wellness and bodybuilding companies.

 

Nutrition Distribution is responsible for distributing hundreds of cease and desist letters. They also demand settlement payments from companies who sell nutritional products . However, they alleged their business decreased due to its competitor’s false advertising. One of the companies that Nutrition Distribution filled an injunction against is Enhanced Athlete.

 

To say the least Enhanced Athlete has challenged their accusations. Nutrition Distribution is actually in the business of bullying its competitors. Enhanced Athlete believes that these claims are meritless. Nutrition Distribution has never been able to show the correlation between false advertising by competitors and their direct sales.

 

Enhanced Athlete won the favor of the judge effortlessly based on the lack of evidence against it. The Nutrition Distribution injunction was merely speculative. The court ruled in favor of Enhanced Athlete and denied the injunction. The company target lawsuits are simply claims with no factual proof. They have simply had no evidence or cause to its claims.

 

Enhanced Athlete CEO Scott Cavell stated that his company will not become victimized by Nutrition Distributions lawsuit schemes. The company is deliberately making false claims against its competitors. He said if Nutritional wellness companies continue to pay value settlements they will continue the lawsuits.

 

Incidentally, Nutrition Distribution’s uses its victories in court as a model to file lawsuits against other competitors. The lawsuit model is established whenever a company pays settlement payments. Enhanced Athlete decided to challenge the company and demand proof to its accusations. Needless to say, they were unable to provide such evidence.

 

Michael Adams, Enhanced Athlete attorney said the court’s decision against Nutrition Distribution is the latest in a line of decisions concerning them. The company Has only speculated that their direct sales have decreased due to its competitor’s false advertising. The company has failed to give a cause for its lawsuits.

 

As a result, the injunction by the Nutrition Distribution, LLC against Enhanced Athlete is overturned. Nutrition Distribution failed to support its claim of decreased sales due to false advertising by Enhanced Athlete. Their accusations are causeless and speculative. The Judge ruled in favor of Enhanced Athlete innocence due to a lack of evidence.
